By visiting the ChipSharks.com website; signing in or making use of a membership with ChipSharks.com (whether via the website or any other means); downloading software associated with ChipSharks.com (the " Software") or obtaining it by any other means; installing or operating the Software; or accepting any prize from ChipSharks.com, you (the "Participant") warrant and certify your understanding and acceptance of the rules of participation, Terms of Service (the "Terms of Service") set forth below.
ChipSharks.com grants Participant the right to install and run the Software on any computer for which it was designed. Participant may use the Software only in connection with the ChipSharks.com website.
Use of the information, activities and games (the "Content") of ChipSharks.com may be prohibited in certain jurisdictions. The gaming activities advertised, listed, or presented by this website are not intended for and are not available to persons in jurisdictions where gaming in its various forms is, or may be deemed to be, prohibited.
Participation at ChipSharks.com is at the sole option, discretion and risk of the Participant. Participant accepts that it is his/her sole responsibility to ascertain whether gaming is legal in his/her jurisdiction and to comply fully with any laws and regulations relevant and applicable in his/her jurisdiction. Participant acknowledges that ChipSharks.com is unable to and makes no representations or warranties, implicit or explicit, as to the legal right for Participants to participate in posted games or post and/or host games. ChipSharks.com also disavows responsibility for any and all actions occurring at events posted and make no guarantees of winning using any posted information.
Participant understands and acknowledges that no purchase is necessary or required to access Content. Participant represents and warrants that the purpose of the Participant entering the accessing Content is solely for the Participant's own personal entertainment. Any other purpose for entrance, access, use or reuse of the ChipSharks.com website by Participant is strictly prohibited. By participating, Participant acknowledges that he/she does not find the content of ChipSharks.com or the website to be offensive, objectionable, unfair, nor indecent.
During the sign-up process, Participant must accurately and truthfully provide the following information:
Email address, city, state/province, zip code, and age. This information is used to automatically create a membership with ChipSharks.com.
When participating in content, Participant agrees to avoid use of foul language, sexually explicit content, and other offensive content. Participant also agrees that, at the sole discretion of ChipSharks, the Participants account may be terminated for any reason.
Participant is solely responsible for keeping his/her alias and password secure and secret. If Participant misplaces, forgets, loses, or is otherwise unable to enter ChipSharks.com because of anything other than ChipSharks.com error, or if a Participant gives away, discloses or loses his or her alias and password, ChipSharks.com will not be responsible or held liable for any claims regarding that account.
Participant shall not allow any other person whatsoever to use or reuse Participant's account, access and/or use any materials or information from the website, accept any prize, or participate in the site content.
ChipSharks.com reserves the right to refuse access to ChipSharks.com to any person.
In the event of any dispute regarding any entry or eligibility for a prize or winnings, the decision of ChipSharks.com will be final and binding.
ChipSharks.com reserves the right to cancel Participant's account for any reason. In no event shall ChipSharks.com be liable for the cancellation of any Participant accounts.
By accepting any prize and/or winnings from ChipSharks.com, Participant acknowledges compliance with these Terms of Service and consents to the use of his/her name for advertising and promotional purposes. All applicable taxes, if any, on any prize is Participant's sole responsibility.
Participant understands and acknowledges that the term "ChipSharks.com" is the trademark, service mark, and trade name of ChipSharks.com, and Participant obtains no rights to such term, nor any other terms, graphics, text, concepts or methodologies, by using the website and the material contained therein.
Materials of the Content (whether electronically obtained or obtained by other means) are automatically void if counterfeited, mutilated, forged, altered or tampered with in any way, if illegible, mechanically or electronically reproduced, obtained outside authorized legitimate channels or if they contain printing, production, typographical, mechanical, electronic or any other errors.
ChipSharks.com will not be responsible for any technical difficulties associated with ChipSharks.com, its software or the website. In particular, but without limiting the generality of the foregoing, ChipSharks.com will not be liable to any person: (a) in the event of force majeure; (b) for the failure of, or damage or destruction to the server or records or any part thereof; (c) for delays, losses, errors or omissions resulting from failure of any telecommunications or other data transmission systems or (d) for attempts by Participant to participate in the Content by methods, means or ways not intended by ChipSharks.com.
Employees of ChipSharks.com, its licensees, distributors, affiliates, agents and members of the immediate families of each are not eligible to receive prizes.
Participant agrees to hold ChipSharks.com, its employees, officers, directors, licensees, distributors, affiliates and agents harmless, and shall fully indemnify the same from any and all costs, expenses, liabilities and damages whatsoever that may arise as a result of Participant's; (i) entry, use, or reuse of ChipSharks.com website, (ii) use of any materials at or obtained from the website, (iii) entry, use, or reuse of ChipSharks.com server, (iv) participation in the Content, (v) the acceptance of any Prize, or, (vi) use or reuse of ChipSharks.com software, whether downloaded from the website or obtained by any other means.
Participant further and specifically indemnifies and holds harmless ChipSharks.com, its employees, officers, directors and any an all associated or affiliated persons or organizations against any and all costs, expenses, liabilities and damages arising from any legal or other action taken either by or against the Participant arising from any and all interaction with ChipSharks.com and/or its employees, officers, directors and any and all associated or affiliated persons or organizations.
Participant confirms that: (i) these Terms of Service are agreed to by reason of Participant visiting ChipSharks.com.
These Terms of Service represent the complete, final and exclusive agreement between the Participant and ChipSharks.com, and supersedes all prior agreements, representations and understandings between them.
Acknowledgment and Agreement
In consideration for being permitted to participate in activities provided by ChipSharks.com, Participant represents and warrants to ChipSharks.com that he/she fully understands, agrees to, becomes a party to and shall abide by the Terms of Service as such Terms of Service may change from time-to-time. The Participant agrees to review the Terms of Service periodically to ensure that he or she is aware of any changes and additions. The Terms of Service contained herein may be modified and/or amended only by ChipSharks.com posting such modification and/or amendment in the "Terms of Service" section of the website. It is the Participant's responsibility to ensure that it is aware of any such modifications.
Participant agrees not to open, use or reuse an account at ChipSharks.com, nor participate at, nor accept any prize from ChipSharks.com if the Participant does not fully understand, agree to become part to and agree to abide by the Terms of Service.
